EarthConsole® Description

Progressive Systems provides an on-line platform, called EarthConsole®, to support the development, test and hosting of Applications or Processors provided by Institutions, Researchers, Service Companies, Start-ups and other customers for enabling Earth Observation (EO) data access and processing services. Registered users, even if not affiliated with the customer’s organization, may request access to these services in accordance with the specific access policy agreed with the customer.

EarthConsole® is a cloud-based platform resorting to one or more third parties’ infrastructures to ensure that processing capacity and EO data of interest are co-located.

Warranty on EarthConsole® Services

Progressive Systems doesn’t provide any warranty for the services available on EarthConsole®. Progressive Systems shall not be deemed liable in respect of a defective Service output. All other conditions, warranties of any kind, written, oral, statutory, expressed or implied by statute or common law with respect to any output product including but not limited to the implied warranty of satisfactory quality, merchantability and fitness for purpose are hereby excluded.

Third-party Processors

EarthConsole® services are frequently based on third party processors. These processors are provided for the convenience and interest of users and on the part of Progressive Systems this implies neither responsibility for, nor approval of, processing results. Progressive Systems makes no warranty either express or implied, as to the accuracy, availability, or contents of processing results.

Disclaimer

Access to, and use of, EarthConsole® constitutes acceptance of the following general terms and conditions.

Neither Progressive Systems nor any other party involved in creating, producing, or delivering the services on EarthConsole® shall be liable for any direct, incidental, consequential, indirect, or punitive damages arising out of Users access to, or use of, the platform. EarthConsole® does not guarantee the accuracy of information provided by external sources and accepts no responsibility or liability for any consequences arising from the use of such data or data loss.

Nothing in the above paragraphs and in these Terms of Use shall be deemed to eliminate or limit, in any respect, Parties’ involved express obligation to pay the Services supplied, expenses and other amounts in accordance with the Agreement incorporating or making reference to the present Terms of Use.

Though Progressive Systems uses the best technical standards to control its site, material on this platform may inadvertently include technical inaccuracies or other errors. We would be grateful if users could notify us of any errors or inaccuracies they may find. Please note that users browse and use the website at their own risk. Progressive Systems does not warrant that the functional aspects of the platform will be uninterrupted or error free or that this platform, or the server that makes it available, are free of viruses or other harmful components. Progressive Systems may change material on the platform without prior notice.”

Fees

User registration is free. For the use of services available on EarthConsole®, please refer to the pricing list.

EarthConsole® Service Quality

The service is provided through one or more third parties infrastructures. Service Quality and Support related to specific different processors is not assured by Progressive Systems.

Users are encouraged to submit to the EarthConsole® Support comments, which might lead to improvements in the quality of the service or of the Output Product.

Availability

During normal working days (in Italy), the service is always active, except when network or servers maintenance activities are being performed or due to circumstances beyond Progressive Systems control. The service is monitored on a daily basis, during normal working days. When the service fails during non-working hours, it will be restarted after the next monitoring activity.

Service Termination

If the user defaults in or commits any breach of any of his obligations, Progressive Systems shall have the right forthwith to terminate the provision of the services. In no case any refund shall be due to the user.

Any termination shall not prejudice or restrict the rights or remedies of Progressive Systems.

Trademarks and other IPRs

All brand names and product names are trademarks or registered trademarks or services marks of their respective owners.

Customer owns all Intellectual Property Rights in Customer Data, Customer Code, and Customer Application(s), and Progressive Systems owns all Intellectual Property Rights in the Services and Software.

Unauthorized Access

Users shall not disclose or share their password with any third parties or use their password for any unauthorized purpose. Users shall not provide access to EarthConsole® to other persons through use of their password. Users are solely responsible to ensure that no action or omission takes place which results in any other person utilizing their password.

Malicious Intent

Users shall not use any device, software or routine to interfere or attempt to interfere with the proper working of EarthConsole®. Users shall not take any action which imposes an unreasonable or disproportionately large load on our infrastructure. Users shall not tamper in any way with the software or functionality of EarthConsole®.

Retention Policy

Processing results elaborated through the EarthConsole® P-PRO service will be kept for a maximum of two weeks from the end date of the processing, in agreement with the user. After such period the processing results will be automatically deleted from the system and it will not be possible to recover unsaved data. We invite EarthConsole® users to download processing results from the system to their premises once the processing is completed. The Earth Console G-BOX VM images will be kept for a period of three working days after the expiration date. Longer periods of retention will be quoted upon user’s request.
